Halen devam eden krize ili\u015fkin olarak bir tarafta, esas itibari ile, <strong>Amerika Birle\u015fik Devletleri ve Avrupa Birli\u011fi<\/strong> di\u011fer tarafta ise <strong>Rusya Federasyonu<\/strong>, birbirlerine kar\u015f\u0131 ve aralar\u0131ndaki sivil havac\u0131l\u0131k faaliyetlerini k\u0131s\u0131tlayan <strong><em>Tek Tarafl\u0131 Tedbirler<\/em> <\/strong>alm\u0131\u015flar; daha \u00e7ok kullan\u0131lan ifadesi ile birbirlerine yapt\u0131r\u0131mlar uygulam\u0131\u015flard\u0131r. Mevcut durumda ve en geni\u015f anlam\u0131 ile <strong>t<em><strong>a<\/strong>raflar\u0131n hava sahalar\u0131 di\u011fer taraf\u0131n tescilinde olan u\u00e7aklara kapal\u0131d\u0131r.<\/em><\/strong><\/p>\n<p>Havac\u0131l\u0131k tarihi, asl\u0131nda bir anlamda da, Devletlerin uzla\u015fmas\u0131 neticesinde olu\u015fturulmu\u015f bir uluslararas\u0131 anla\u015fmalar tarihidir. K\u0131sa ad\u0131 ile, <strong><a href=\"http:\/\/mevzuat.shgm.gov.tr\/umevzuat\/kanun\/4749_Sayili_Kanun_sikago.pdf\" target=\"_blank\" rel=\"noopener\">1944 Tarihli \u015eikago Konvansiyonu<\/a>,<\/strong> Devletlerin birbirlerine hava sahalar\u0131n\u0131 nas\u0131l kulland\u0131racaklar\u0131 ve bu kullan\u0131m\u0131 nas\u0131l k\u0131s\u0131tlayabileceklerine dair en temel uluslararas\u0131 hukuk metnidir.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone wp-image-1257 \" src=\"https:\/\/artekinlaw.com\/wp-content\/uploads\/2023\/03\/100103815_1418573018341713_3748777657882378240_n.jpg\" alt=\"\" width=\"1005\" height=\"689\" srcset=\"https:\/\/www.artekinlaw.com\/wp-content\/uploads\/2023\/03\/100103815_1418573018341713_3748777657882378240_n.jpg 713w, https:\/\/www.artekinlaw.com\/wp-content\/uploads\/2023\/03\/100103815_1418573018341713_3748777657882378240_n-300x206.jpg 300w\" sizes=\"(max-width: 1005px) 100vw, 1005px\" \/><\/p>\n<p><strong>\u015eikago Kon<em>vansiyonu<\/em><\/strong><em>\u2019<\/em>nun 1. Maddesi\u2019nde Taraf Devletler, di\u011ferlerinin kendi \u00fclkeleri \u00fcst\u00fcndeki hava sahas\u0131 \u00fczerinde <strong><em>\u201ctam ve m\u00fcnhas\u0131r hakimiyete\u201d<\/em> <\/strong>sahip olduklar\u0131n\u0131 kabul etmi\u015flerdir. Buna g\u00f6re, her bir Taraf Devlet kendi hava sahas\u0131n\u0131 di\u011ferlerine a\u00e7ma ve kapama hakk\u0131na mutlak olarak sahiptir. <strong>\u015eikago Konvansiyonu<\/strong>\u2019nun sadece 1. Maddesi\u2019ne bakarak Devletlerin hava sahalar\u0131n\u0131 di\u011ferlerine istedi\u011fi \u015fekilde kapayabilece\u011fini s\u00f6ylemek; ilk g\u00f6r\u00fcn\u00fc\u015fte hakl\u0131 bir tespit olsa da kanaatimizce, \u00f6zellikle baz\u0131 a\u00e7\u0131lardan, hem erken ve hem de b\u00fct\u00fcnc\u00fcl bak\u0131\u015f a\u00e7\u0131s\u0131n\u0131 ortadan kald\u0131ran bir yorum da olabilecektir.<\/p>\n<p><strong>\u015eikago Konvansiyonu<\/strong>\u2019nun Ba\u015flang\u0131\u00e7 b\u00f6l\u00fcm\u00fcnde Devletler aras\u0131 mutabakat\u0131n <em>\u201cMilletleraras\u0131 Sivil Havac\u0131l\u0131\u011f\u0131n emin ve muntazam bir tarzda inki\u015faf edebilmesi ve hava ula\u015ft\u0131rma servislerinin m\u00fcsavi imkanlar esas\u0131 \u00fczerine tesisi ile sa\u011flam ve ekonomik bir \u015fekilde i\u015fletilebilmesi\u201d<\/em> \u00f6z\u00fcnde oldu\u011fu belirtilmektedir. Maddesi\u2019ne g\u00f6re Bir Taraf Devletin sicilinde tescilli olan u\u00e7aklar\u0131n; bu devlete giri\u015f \u00e7\u0131k\u0131\u015f\u0131na, i\u00e7eride i\u015fletilmesine ve u\u00e7u\u015funa dair tabi oldu\u011fu kurallar di\u011fer Taraf Devletlerin sicilinde kay\u0131tl\u0131 olan u\u00e7aklara da ayr\u0131m yap\u0131lmaks\u0131z\u0131n aynen uygulanacakt\u0131r, bu maddenin konvansiyonun di\u011fer h\u00fck\u00fcmleri ile uyumlu olarak uygulanaca\u011f\u0131 da ayr\u0131ca h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. <strong>\u015eikago Konvansiyonu\u2019nun 44. Maddesi\u2019<\/strong>nin (g) paragraf\u0131nda, <a href=\"https:\/\/www.icao.int\/Pages\/default.aspx\" target=\"_blank\" rel=\"noopener\"><strong>Uluslararas\u0131 Sivil Havac\u0131l\u0131k \u00d6rg\u00fct\u00fc\u2019n\u00fcn (ICAO)<\/strong> <\/a>ama\u00e7lar\u0131 aras\u0131nda, <strong>Taraf Devletler<\/strong> aras\u0131nda ayr\u0131mc\u0131l\u0131k yap\u0131lmamas\u0131na i\u015faret edilmi\u015ftir, di\u011fer ilgili ama\u00e7lar, \u00f6zetle, uluslararas\u0131 sivil havac\u0131l\u0131\u011f\u0131n geli\u015fmesi (a), u\u00e7aklar\u0131n bar\u0131\u015f\u00e7\u0131l ama\u00e7larla i\u015fletilmesini ve hava ula\u015f\u0131m\u0131n\u0131n kolayla\u015ft\u0131r\u0131lmas\u0131n\u0131 desteklemek (b), Taraf Devletlerin haklar\u0131na uyulmas\u0131n\u0131 ve her birinin uluslararas\u0131 hava ula\u015f\u0131m\u0131 imkan\u0131na sahip olmas\u0131n\u0131 sa\u011flamak (f) olarak an\u0131labilir.<strong> \u015eikago Konvansiyonu\u2019<\/strong>nun 15. Maddesi h\u00fckm\u00fcnce, uluslararas\u0131 hava limanlar\u0131n\u0131n, t\u00fcm Taraf Devletlerin sicillerinde kay\u0131tl\u0131 u\u00e7aklara ayn\u0131 \u015fartlarda a\u00e7\u0131k bulundurulmas\u0131 gereklidir; t\u00fcm di\u011fer kolayl\u0131klar da buna dahildir.<\/p>\n<p><strong> \u015eikago Konvansiyonu<\/strong>\u2019nun 22. Maddesi ise Taraf Devletlerin, di\u011fer Taraf Devletlerin sicilinde tescilli u\u00e7aklar\u0131n operasyonlar\u0131na dair i\u015flemleri kolayla\u015ft\u0131rmalar\u0131n\u0131 gerekli k\u0131lmaktad\u0131r.<strong> ICAO Genel Kurulu,<\/strong> 2019 Tarih ve A40-9 Say\u0131l\u0131 Karar\u0131 EK A B\u00f6l\u00fcm 3 taht\u0131nda, \u00dcye Devletlerin tek tarafl\u0131 tedbirlerle uluslararas\u0131 sivil havac\u0131l\u0131\u011f\u0131n geli\u015fimini \u00f6nlememelerini h\u00fck\u00fcm alt\u0131na alm\u0131\u015ft\u0131r. \u015eikago Konvansiyonu\u2019nu takiben imzalanan <strong>Transit Anla\u015fmas\u0131 ile Taraf Devletler <\/strong>hava sahalar\u0131n\u0131n \u00fczerinden u\u00e7ulmas\u0131na dair 1. Trafik Hakk\u0131 ile Zorunlu \u0130ni\u015fe dair 2. Trafik Hakk\u0131n\u0131 birbirlerine tan\u0131m\u0131\u015flard\u0131r. Hem Chicago Konvansiyonu hem de Transit Anla\u015fmas\u0131 pek \u00e7ok Devlet taraf\u0131ndan imza edilmi\u015f durumdad\u0131r. \u0130kili veya \u00c7ok Tarafl\u0131 Hava Ula\u015ft\u0131rma Anla\u015fmalar\u0131yla da <strong><em>Devletler, birbirlerine hava sahalar\u0131n\u0131, ticari olan 3, 4, ve 5. Trafik Haklar\u0131 i\u00e7in (a\u011f\u0131rl\u0131kl\u0131 olarak) kulland\u0131rmaktad\u0131r.<\/em><\/strong><\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-1251 size-full\" src=\"https:\/\/artekinlaw.com\/wp-content\/uploads\/2023\/03\/thumb__2000_0_0_0_auto-e1680469206779.png\" alt=\"\" width=\"1432\" height=\"1122\" srcset=\"https:\/\/www.artekinlaw.com\/wp-content\/uploads\/2023\/03\/thumb__2000_0_0_0_auto-e1680469206779.png 1432w, https:\/\/www.artekinlaw.com\/wp-content\/uploads\/2023\/03\/thumb__2000_0_0_0_auto-e1680469206779-300x235.png 300w, https:\/\/www.artekinlaw.com\/wp-content\/uploads\/2023\/03\/thumb__2000_0_0_0_auto-e1680469206779-1024x802.png 1024w, https:\/\/www.artekinlaw.com\/wp-content\/uploads\/2023\/03\/thumb__2000_0_0_0_auto-e1680469206779-768x602.png 768w\" sizes=\"(max-width: 1432px) 100vw, 1432px\" \/><\/p>\n<p><strong>Rusya Federasyonu-Ukrayna krizi<\/strong> ile birlikte, A<strong>vrupa Birli\u011fi 833\/2014 Say\u0131l\u0131 T\u00fcz\u00fc\u011f\u00fc\u2019n\u00fc 2022 y\u0131l\u0131nda<\/strong> revize ederek; \u00f6zetle <strong>Rus Havayollar\u0131<\/strong> taraf\u0131ndan i\u015fletilen, Rusya\u2019da tescilli veya tescilli olmasa bile bir \u015fekilde Ruslar taraf\u0131ndan i\u015fletilen t\u00fcm u\u00e7aklara <strong>Avrupa Birli\u011fi Hava Sahas\u0131n\u0131 ve Hava Limanlar\u0131n\u0131<\/strong> kapatm\u0131\u015ft\u0131r; benzer \u015fekilde <strong>Amerika Birle\u015fik Devletleri de Ula\u015ft\u0131rma Departman\u0131\u2019n\u0131n (DoT)<\/strong> <em>2022 Tarih ve 2022-3-2 Say\u0131l\u0131 Karar\u0131 ile Rus u\u00e7ak i\u015fletmecilerinin \u00fclkesine u\u00e7ak y\u00f6nlendirmesini yasaklam\u0131\u015ft\u0131r.<\/em> \u0130lgili Tek Tarafl\u0131 Tedbirler kapsam\u0131nda, Rusya ile izah edildi\u011fi \u015fekilde ili\u015fkilendirilen <em><strong>u\u00e7aklar\u0131n tamir, bak\u0131m ve revizyonu ile sigorta ettirilmeleri de nerede ise imk\u00e2ns\u0131z hale gelmi\u015ftir.<\/strong><\/em> \u0130lave olarak, <strong>Rusya Federasyonu<\/strong> da pek \u00e7ok \u00fclkeye hava sahas\u0131n\u0131 kapatm\u0131\u015ft\u0131r. 2022 y\u0131l\u0131ndaki ba\u015fka bir \u00f6nemli geli\u015fme ise, Rusya Federasyonu ile imzalad\u0131\u011f\u0131 83bis Anla\u015fmas\u0131 kapsam\u0131nda u\u00e7u\u015fa elveri\u015flilik yetkisini ve Rusya Federasyonu\u2019nundaki havayollar\u0131na ait pek \u00e7ok u\u00e7a\u011f\u0131n tescilini elinde bulunduran Bermuda, bu u\u00e7aklar\u0131n u\u00e7u\u015fa elveri\u015flilik sertifikalar\u0131n\u0131 iptal etmi\u015f ve<strong> Rusya Federasyonu<\/strong> taraf\u0131ndan yere indirilmelerini talep etmi\u015f olmas\u0131d\u0131r. <strong>Rusya Federasyonu ise Bermuda ile olan 83bis Anla\u015fmas\u0131\u2019<\/strong>n\u0131 ask\u0131ya ald\u0131\u011f\u0131n\u0131 beyan ederek Bermuda\u2019dan, bu u\u00e7aklar\u0131n tescilden terkinini istemi\u015f, Bermuda bu talebi reddetse de Rusya Federasyonu bu u\u00e7aklar\u0131 kendisi de tescil etmi\u015ftir. Oysa ki; <strong>\u015eikago Konvansiyonu<\/strong>\u2019nun 18. Maddesi\u2019ne g\u00f6re bir u\u00e7a\u011f\u0131n tek bir tescili olabilir \u00e7\u00fcnk\u00fc \u00f6ncesindeki 17. Maddesi<\/strong> ahde vefa ilkesine dair olup, bir uluslararas\u0131 anla\u015fmaya Taraf Devletlerin, bu anla\u015fmaya iyi niyetle uymalar\u0131 gerekmektedir, yine ayn\u0131 konvansiyonun 27. Maddesi\u2019ne g\u00f6re, bir Taraf Devlet i\u00e7in i\u00e7 hukuku, bir uluslararas\u0131 anla\u015fmay\u0131 ask\u0131ya almak i\u00e7in gerek\u00e7e olu\u015fturamaz, <strong><em>60. Bununla birlikte, sava\u015f gerek\u00e7e g\u00f6sterilerek, \u00fclkelerin g\u00fcvenlik ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamaktan \u00e7ok di\u011fer \u00fclkeleri ekonomik a\u00e7\u0131dan zor duruma d\u00fc\u015f\u00fcrme gayesi ta\u015f\u0131yan <strong>Tek Tarafl\u0131 Tedbirlerin, \u015eikago Konvansiyonu ama\u00e7lar\u0131,<\/strong> buna g\u00f6re \u00e7izilen istikamet ve <em><strong>Viyana Antla\u015fmalar Hukuku S\u00f6zle\u015fmesi prensipleri<\/strong> <\/em>ile uyumlu olmad\u0131\u011f\u0131n\u0131 de\u011ferlendiriyoruz. <strong>Uluslararas\u0131 Sivil Havac\u0131l\u0131k<\/strong> ad\u0131 \u00fczere sivildir, insanl\u0131\u011fa hizmet i\u00e7in vard\u0131r ve bu nedenle geli\u015ftirilmi\u015ftir, <strong><a href=\"https:\/\/artekinlaw.com\/tr\/\" target=\"_blank\" rel=\"noopener\">seyahat insanlar i\u00e7in bir \u00f6zg\u00fcrl\u00fckt\u00fcr.<\/a><\/strong> Tek Tarafl\u0131 Tedbirlerle getirilen k\u0131s\u0131tlamalar\u0131n nihayetinde sivilleri olumsuz etkiledi\u011fini d\u00fc\u015f\u00fcn\u00fcyor ve <strong>Taraf Devletlerin, Rusya\u2019n\u0131n da Konsey\u2019e<\/strong> geri d\u00f6nd\u00fc\u011f\u00fc, tam kat\u0131l\u0131mc\u0131 bir <strong>ICAO <\/strong>\u00f6nderli\u011finde gerekli rahatlat\u0131c\u0131 tedbirleri almas\u0131n\u0131 \u00fcmit ediyoruz.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yazar: Av.
